MR Woodcraft Ltd – Standard Terms and Conditions (Your statutory customer rights are not affected). Purchase/registration of personal details is deemed acceptance of these terms.
Definitions
The term ‘Seller’ refers to ‘MR Woodcraft Ltd’ and the company websites. The term ‘Customer’ refers to the person or company to whom this document is addressed.
1 General
1.1 These terms and conditions are applicable to the supply of products procured, manufactured or sold by the Seller to the Customer with reference to the aforementioned definitions.
2 Price
2.1 All prices are quoted in Pounds Sterling unless otherwise specified.
2.2 Tree swing, homely items and house sign prices are inclusive of packing and delivery to the UK mainland. All other prices are exclusive of delivery, unless otherwise stated.
3 Payment
3.1 Payment must be made in Pounds Sterling, unless otherwise specified. Payment must be made by one of the following payment methods:
Cheque – payable to MR Woodcraft Ltd.
Major debit/credit cards as listed: (Mastercard, Visa, Visa Debit, Switch/Solo, VisaElectron,)
PayPal – you will be transferred to PayPal for order processing.
Bank Transfer (customer to incur all derived charges). Available by request.
3.2 Unless otherwise agreed payment must be made at the time of the customer order. For items with a deposit paid at the time of order, the balance must be paid 5 working days prior to delivery.
4. Passing of property
4.1 MR Woodcraft Ltd shall retain the property of the goods at all times until full payment has been made by the customer and has been received by MR Woodcraft Ltd. Delivery will only occur after full payment has been made, unless expressly agreed in advance.
5. Passing of risk
5.1 The risk in the goods shall pass to the Customer once the goods have left the premises of MR Woodcraft Ltd. MR Woodcraft Ltd cannot be held liable for any accident/injury/death caused by the use of its products, either directly or indirectly. MR Woodcraft Ltd products are used at the customers own risk.
5.2 Our Swing seats and swing frames are to be used for gentle swinging only. Any ‘swinging’ motion beyond the parameters of the supporting frame should be avoided and MR Woodcraft Ltd will not be held liable for any losses due to misuse of the product.
6. Delivery
6.1 It is our policy to try to fulfil all orders on stocked items within the advertised and/or agreed delivery timeframe. For Make To Order goods, delivery will be as per date agreed (to be considered as indicative only). Orders for products that are not readily available for immediate sale, will not be accepted unless agreed to by the customer. In such a case, MR Woodcraft Ltd will agree a delivery schedule, which shall also be considered as indicative only. Said products will be sent to the Customer as soon as possible, following manufacturer. MR Woodcraft Ltd accepts no liability or responsibility for delays in the delivery caused by the manufacturing, or any other third party. Deliveries advised with a lead time will be deemed to have been delivered within a reasonable period of time if delivered within 2 months of the advised date. Delivery is to the entrance floor of the property only. Where the company installs products, this will be only provided access is easily available for the goods to the installation location and that the surface has been levelled and prepared beforehand.
6.2 MR Woodcraft Ltd reserves the right to make partial deliveries should it be deemed appropriate. In such a case, consent and agreement will be sought from the customer prior to dispatch.
6.3 It is the customers responsibility to ensure their purchase will fit into the property. Should a delivery fail because the purchase cannot enter the property MR Woodcraft Ltd will retain its reasonable costs incurred.
6.4 Delivery Services. Courier delivery to door threshold/kerbside. Company delivery is position in garden. MR Woodcraft Ltd will arrange a delivery date and time to suit the customer and the business prior to the goods being dispatched. For items sent by courier customers will receive a notification from the courier and will be able to amend delivery schedules themselves.
6.5 For items delivered but not installed or erected by MR Woodcraft Ltd, the customer accepts full responsibility to ensure the item is put together correctly, safely and securely. MR Woodcraft Ltd cannot be held liable for any damage caused to the item whilst being installed/erected by somebody other than an MR Woodcraft Ltd employee. Any replacement parts needed to rectify any issues caused by anyone other than an MR Woodcraft Ltd employee will be at the customers own expense.
6.6 In the event of our drivers being unable to complete delivery because there is no suitable person available to accept delivery, the goods will be returned to MR Woodcraft Ltd and the customer will be liable for the cost of re-delivery. This charge must be settled before the goods are re-dispatched.
7 Acceptance
7.1 The Customer shall inspect the goods within a reasonable time period following receipt. The goods shall be deemed to have been accepted by the customer 7 days after their receipt unless the Customer has notified the Seller that the goods are rejected. (This does not however affect the Customer’s statutory rights). If no notification of rejection has been received after the aforementioned 7 day period, MR Woodcraft Ltd shall consider the goods to be of satisfactory quality and fit for their purpose, and may decline rejection thereafter. This 7 day period only applies to website, Email and telephone purchase sales.
8 Return procedure
8.1 If the goods are to be rejected in the time limit set in clause 7.1 above, the Customer shall comply with the return procedure as defined in clause 8.2, below. MR Woodcraft Ltd will reject returned goods that are unsolicited from Customers that have not complied with the procedure set in clause 9.2 below.
8.2 Goods that are rejected by the Customer must be returned in a saleable condition, unless faulty. The Customer must contact MR Woodcraft Ltd before returning any goods. If it is agreed that the goods should be returned, the Customer will be advised on how to return the goods. The cost of all returns and exchange are with the customer unless otherwise agreed. In the event that a product becomes faulty during the guarantee period (see clause 11), MR Woodcraft Ltd shall repair or replace the product – which ever is the least cost option.
9 Cancellations
9.1 Cancellations are only accepted if the Customer complies with the following cancellation procedure and before the order has been dispatched. Orders online must be cancelled prior to despatch and within seven days of purchase for a monetary refund. A full credit will not be given on bespoke, made to order items. The customer will forfeit the deposit paid.
9.2 Cancellations can be made with MR Woodcraft Ltd by phoning 01449 741744 and requesting for the order to be cancelled. A credit note to the value of purchase will be issued, and this may be used on all products within 6 months of receipt.
10 Copyrights and Other Intellectual Property
10.1 Except where otherwise expressly noted, all contents of MR Woodcraft Ltd owned literature or websites, are the sole and exclusive property of MR Woodcraft Ltd. The re-sale and/or re-labelling of any product sold by MR Woodcraft Ltd is expressly forbidden unless agreed in writing with MR Woodcraft Ltd. MR Woodcraft Ltd may, at any time, make modifications, changes, and alterations to the contents of its literature and websites, including these Terms and Conditions, without prior notice.
11 Guarantee
11.1 We guarantee your furniture against faulty workmanship for 1 year. We sell natural timber products and these can change naturally whilst still being perfectly fit for purpose and not faulty. We guarantee workmanship. We cannot guarantee a product wont behave naturally in its natural environment. We do not guarantee: Against timber movement, cracks, swelling & shrinkage as these are all natural behaviours of wood in its local environment – many or all of these will revert when environmental conditions, (e.g temperature & humidity), change back. These can manifest themselves as furniture that is stiffer, looser, gaps that narrow & widen & joints that create noise. That moving parts will not require lubrication or adjustment. Against changes in texture, colour and general appearance of timber or upholstery. Any type of accidental damage. In particular the result of moving or handling the furniture. Possible emergence of wood boring insects holes. That an identical item will be offered in the event of replacement. Nor any claim may have a higher monetary value than the product being claimed against. The behaviour of timber, or against changes in materials due to use or factors in your local environment, or against accidental damage, deliberate damage, mis-use & fair wear and tear.
12 Law
12.1 These terms and conditions are governed and shall be interpreted in accordance with English law.
